Privacy Policies

THIS NOTICE DESCRIBES HOW PROTECTED HEALTH INFORMATION (PHI) ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

The following categories describe different ways that we may use and disclose your protected health information. The following are examples in certain categories; however, not every use or disclosure in a category will be listed.
Treatment. We may use and disclose your PHI to coordinate the treatment and/or services you receive.
Payment. We may use or disclose your PHI in order to pay for the services you may receive. For example, we may contact your referring/treatment resource to certify that you received treatment, and we may request details regarding your treatment to determine if benefits will cover or pay for your treatment. We also may use arid disclosure of your PHI to obtain payment from third parties that may be responsible for such costs.
Health Care Operations. We may use your PHI for certain operational, administrative, accounting, and continuum of care activities. We may disclose PHI to business associates if they need to receive this information to provide a service to us and will agree to abide by specific HIPAA rules relating to the protection of health information.
​In addition to the abovementioned uses of your PHI related to treatment, payment, and healthcare operations, NDS may also use you PHI for the following purposes:

Plan Sponsors. We may use or disclose PHI to the plan sponsor, if applicable, of the EL group health plan.

Appointment Reminders. We may use or disclose your PHI to contact you and remind you of appointments.

Disclosures Required by Law. NSC will use and disclose your PHI when we are required to do so by federal, state, or local law.

Public Health. As required by law, we may use or disclose your PHI to legal authorities charged with preventing or controlling injury or disability.

Law Enforcement* We may disclose your PHI for law enforcement purposes as required by law or in response to a subpoena or court order.

Agency Oversight Activities. We may disclose your PHI to an oversight agency as required by law. These oversight activities may include audits, investigations, inspections, and credentialing, as required for Licensure and the government to monitor government programs and compliance with civil rights laws.

Lawsuits and Similar Proceedings. If you are involved in a lawsuit or a dispute, we may disclose your PHI in response to a court or administrative order. We may also disclose health. information about you in response to a subpoena, discovery request, or other lawful process instituted by someone else involved in the dispute, but only if efforts have been made, either by the requesting party or us, to tell you about the request or to obtain an order protecting the information requested.

Research. We may disclose your PHI to researchers when their research has been approved by an institutional review board or privacy board that has reviewed the research proposal and established protocols to ensure the privacy of your information.

Notification. We may use or disclose your PHI to notify or assist in notifying a family member, personal representative, or another person responsible for your care regarding your location and general condition.

Victims of Abuse or Neglect. We may disclose PHI about you to a government authority if we reasonably believe you are a victim of abuse or neglect. We will only disclose this type of information to the extent required by law, if you agree to the disclosure, or if the disclosure is allowed by law and we believe it is necessary to prevent serious harm to you or someone else.*

This Notice of Privacy Practices (Notice) applies to BranMor Medical Services, LLC, and all of its subsidiaries and business units (collectively referred to as "BranMor" in this Notice), except to the extent that a subsidiary, division, or business unit of BranMor performs occupational screening, forensic tests, paternity/identity tests, clinical trial tests, or other services that do not involve standard electronic transactions for which the Department of Health and Human Services (HHS) has adopted standards.
Under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), BranMor is required by law to maintain the privacy of health information that identifies you, called protected health information (PHI), and to provide you with notice of our legal duties and privacy practices regarding PHI. BranMor is committed to the protection of your PHI and will make reasonable efforts to maintain the confidentiality of your PHI, as required by statute and regulation. We take this commitment seriously and will work with you to comply with your right to receive certain information under HIPAA.​

Data Sharing
• Customer data is not shared with 3rd parties for promotional or marketing purposes.
• Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.

Your Choices
For certain PHI, you can tell BranMor your choices about what we disclose. If you have a clear preference for how we disclose your information in the situations described below, talk to BranMor. Tell BranMor what you want BranMor to do, and we will follow your instructions.
You have both the right and choice to tell BranMor to disclose your PHI in the following ways:

With your family, close friends, or others involved in your care

In response to a disaster relief situation
If you are not able to tell BranMor your preference, for example, if you are unconscious, we may go ahead and disclose your information if we believe it is in your best interest. We may also disclose your information when needed to lessen a serious and imminent threat to health or safety.
BranMor will request your written permission before disclosing your PHI for marketing purposes.

Additional Safeguards and Protections
BranMor has in place additional safeguards for your PHI consistent with federal and state laws, for example, relating to mental health, HIV/AIDS, and genetic testing. In addition, federally assisted alcohol and drug treatment programs are subject to additional and separate restrictions on the use and disclosure of alcohol and drug abuse treatment information. Where required, BranMor will obtain your permission before disclosing PHI with additional safeguards to other health care providers who are not involved in your treatment program or care.
BranMor's Responsibilities

BranMor will let you know if a breach occurs that has compromised the privacy or security of your PHI.

BranMor will not use or disclose your PHI other than as described in this Notice unless you tell BranMor we can in writing. If you tell BranMor we can, you may change your mind at any time by contacting BranMor in writing.
Changes to the Terms of this Notice
We can change the terms of this Notice, and the changes will apply to all PHI we have about you. The new Notice will be available upon request, in BranMor’s office, and on BranMor’s website.
